Fees That Hospitals Are Allowed to Charge for Medical Records, by State

The fees that hospitals are allowed to charge patients for retrieving and photocopying their medical records are set, in most states, by state statute or regulation.

The table below shows the maximum fees, by state, that a hospital is allowed to charge for producing paper medical records for a patient to use for the purpose of having his or her hospital bill audited. Some of the links lead directly to the listed statute; others lead to a table of contents or an index of statutes that can be used as the starting point from which to search for the listed statute.

NOTE: Under the federal Health Insurance Portability and Accountability Act (HIPAA), medical record copying fees for patients may not include costs associated with searching for and retrieving their medical records (45 CFR 164.524(c)(4)). HIPAA further requires that copying and postage fees be reasonable and cost-based.  In many states, therefore, a hospital that charges a patient the maximum fees allowed under state law appears to be violating federal law.
